March 20, 2024 Filing 6 ORDER granting #2 Motion for Leave to Proceed in forma pauperis: Accordingly, Plaintiffs application to proceed IFP (DE 2) is granted. The Court orders service of the summonses and complaint by the United States Marshal Service (USMS) upon the Defendants forthwith pursuant to 28 U.S.C. 1915(d). Walker v. Schult, 717 F.3d119, 123 n.6 (2d Cir. 2013); see also 28 U.S.C. 1915(d) (The officers of the court shall issue and serve all process in [IFP] cases.); Fed. R. Civ. P. 4(c)(3) (the court must order the USMS to serve if the plaintiff is authorized to proceed IFP)). To allow Plaintiff to effect service on Defendants through the USMS, the Clerk of Court is instructed to fill out a USMS Process Receipt and Return form (USM-285 form) and shall issue a summons to each Defendant and shall deliver to the USMS all the paperwork necessary for the USMS to effect service upon the Defendants. The USMS shall file a return of servicewithin two weeks of completion of service. If the complaint is not served within 90 days after the date the summonses are issued, Plaintiff should request an extension of time for service. See Meilleur v. Strong, 682 F.3d 56, 63 (2d Cir. 2012) (holding that it is the plaintiffs responsibility to request an extension of time for service). Plaintiff must notify the Court in writing if his address changes, and the Court may dismiss the action if Plaintiff fails to do so. The Clerk of the Court shall mail a copy of this Order to Plaintiff at his address of record and note such mailing on the docket. SEE ATTACHED ORDER. So Ordered by Judge Gary R. Brown on 3/20/2024.
