April 10, 2024 ORDER granting #10 Motion for Pre Motion Conference. The Court shall keep the scheduled July 11, 2024 pre-motion conference as the date on which the parties will address defendant's renewed motion for a pre-motion conference (DE 10) in light of plaintiff's amended complaint (DE 9). However, that conference is hereby CONVERTED TO AN IN-PERSON PROCEEDING, which shall take place at 10:30 AM in Courtroom 940, 100 Federal Plaza, Central Islip, NY 11722. Counsel shall appear at such time with their clients. Plaintiffs are directed to respond to DE 10 by April 24, 2024, in accordance with the Court's Individual Rules concerning such letter motions. As stated in this Court's previous Electronic Orders, in appropriate cases, the pre-motion letters, along with counsels' arguments at the pre-motion conference, may be construed, at the discretion of the Court, as the motion itself. Arguments not raised in the pre-motion letters or during the pre-motion conference shall be deemed waived. See In re Best Payphones, Inc., 450 F. App'x 8, 15 (2d Cir. 2011).Before requesting an adjournment, the parties shall meet and confer and submit a joint letter with several proposed dates. The parties and other attendees to the conference are also reminded that the recording of any proceeding of the Court, including this conference, is prohibited under Local Rule 1.8. April 10, 2024 ORDER WITHDRAWING DEFENDANTS' PRE-MOTION CONFERENCE LETTER (DE 8).
