September 23, 2020 Opinion or Order Filing 30 ORDER with respect to #28 Letter Motion to Compel. The Court orders the parties to meet and confer on document requests on Wednesday, September 23, 2020, and to submit a joint letter to the Court on ECF by no later than 5:00 p.m. on Thursday, September 24, 2020 laying out any disputes that remain. For each request that is disputed, the joint letter shall go through each request in number order, laying out the respective positions of each party (Plaintiff first and then Defendant) as to relevance and burden (or other objection) in a discrete short paragraph (no more than six 12 point roman space lines) for each request. The Court will hear the parties by telephone conference at 6:00 p.m. on September 29, 2020. At that date and time, the parties shall dial the Court's conference line at 888-251-2909 (access code: 2123101). In addition, the parties are to meet and confer between September 23, 2020 and September 29, 2020 to attempt to resolve any remaining disputes. Under those standards, and without passing on the question whether Defendant has a right to the documents under the Credit Agreement, at a minimum, the following documents are plainly are relevant and proportional to the needs of the case and must be produced: the documents requested by defense counsel on the second page of the letter dated July 27, 2020, at Dkt. No. 15-7, and the documents requested by defense counsel in the first three bullet points of the letter dated September 2, 2020, at Dkt. No. 28-2.
