OPINION, that Plaintiff ResQNet.com, Inc. ("ResQNet") has moved in limine to preclude Defendant Lansa, Inc. ("Lansa") from offering evidence on or relitigating the issue of infringement, objecting to admission of the Zephyr and Se agull licenses, and offering expert testimony on damages. Defendant Lansa has also moved in limine to exclude the testimony and expert report of ResQNet's expert witness, Dr. Jesse David. For the foregoing reasons, all motions are denied. The parties are directed to appear for a hearing to determine an appropriate royalty rate on January 25, 2011 at 10am in Courtroom 18C. Additional relief as set forth in this Order. MEMORANDUM OPINION: For the reasons set forth above, ResQNet's motion is denied and a new hearing on the issue of a reasonable royalty will be scheduled to occur within 60 days. The parties are directed to exchange pre-hearing briefs in 45 days and any in limine motions will be returnable in 55 days, subject to any agreement the parties may reach on a revised schedule. OPINION #95670: Judgment will be entered in favor of the Plaintiff with regard to the '075 Patent and the Defendants with regard to the '608 Patent. Damages in the amount of $402,237 (net of the $100,000 sanction) are awarded to ResQNet. Lansa shall provide ResQNet with data indicating its NewLook software sales and maintenance fee revenues since March 31, 2007 to which the reasonable royalty rate of 12.5.% shall be applied.
