Filing 437 ORDER TERMINATING THE WORLDCOM VICTIM TRUST, DIRECTING PAYMENT OF THE SURPLUS TO U.S. TREASURY, AND DISCHARGING THE DISTRIBUTION AGENT: ORDERED, that the Motion is hereby granted in all respects, and it is further ORDERED, that the Distribution Agent is authorized to wind-up and terminate the WVT in all respects in advance of the time established in the Court's 2010 Order; and it is further ORDERED, that the form and content of the Final Accounting of the WVT Reserve as depicted in Exhibit B to the Motion is approved; and it is further ORDERED, that the Distribution Agent is authorized to pay the Surplus in the amount of $1,522,179.37 to the U.S. Treasury and thereafter close the Distribution Fund account; and it is further ORDERED, that the Distribution Agent and his Agents are discharged from any claims or liability in connection with the Distribution Plan and the administration of the Fair Fund, and all Potentially Eligible Claimants and other parties are permanently enjoined from prosecuting or asserting any claim or liability in connection with the Distribution Plan and the administration of the Fair Fund against the Distribution Agent and his Agents; and it is further ORDERED, that this Court shall retain exclusion jurisdiction with respect to any disputes or other matters related to, or arising from, the interpretation or implementation of this Order. In the event of confirmation of a plan of reorganization under Chapter 11 of Title 11 of the United States Code with respect to WorldCom, Inc and its affiliated debtors, WorldCom shall satisfy the obligation hereunder (a) by paying $500,000,000 on the effective date of the plan of reorganization to the Clerk of this Court and (b) by transferring, on the effective date of the plan or reorganization or as soon as racticable thereafter, common stock of reorganized WorlCom, Inc, issued purs to any such plan of reorganization or as soon as practicable thereafter, common stock of reorganized WorldCom, Inc., as issued purs to any such plan of reorganization having a value of $250 million to the Distribution Agent to be appointed by Court purs to this Final Judgment; The monetary payment shall be sent to the Clerk of this Court, together with a letter identifying Worldcom, Inc as a defendant in this action; setting forth the title and civil action number of this action and the name of this court; and specifying that payment is made purs to this Final Penalty Judgment; ...
