March 23, 2005 Filing 96 MEMO ENDORSEMENT, The City was remiss in not consulting with plaintiff's counsel before scheduling these depositions on such short notice. Such consultation is a matter of common courtesy. Nonetheless, because the City noticed the depositions to take place before the discovery cutoff, they may proceed. Inasmuch as Mr. Perez finds it a hardship to conduct these depositions on the dates at issue, Mr. Zuckerman shall telephone Mr. Perez to schedule them at the mutual convenience of the parties, provided they take place on or before 4/20/05. Any other depositions already noticed may be similarly adjourned on consent to suit counsel's schedules. Because the City's scheduling of the depositions shows that it believes three of these depositions could be completed in a single day (and that the remaining two could be completed on a date on which another deposition was already scheduled), the court will hold the City to this schedule.
