Filing 11 PARTIES' 26(f) PLANNING REPORT; (Signed by Judge Debra C. Freeman on 9/20/04) (sac, ) |
Filing 10 JOINT STIPULATION; the parties are permitted to add plaintiffs for a period of 90 days up to and including 12/20/04. Rather than submitting an amended complaint, plaintiffs may be added by filing a list identifying the name and social security number of each plaintiff added and a consent to sue form from the additional plaintiffs. The plaintiffs added to the case in this manner will be deemed to have made the allegations in the plaintffs' complaint filed on 6/15/04. The defendants will not file an answer each time that plaintiffs are added to the case; rather, its answer filed on 9/9/04, will be deemed to apply to the plaintiffs who are subsequently added to the case. Plaintiffs' attorneys will make a good faith effort to join all eligible plaintiffs to the case on or before 12/20/04, and thereafter plaintiffs' counsel will not solicit individuals who are similarly situated to the plaintiffs in the instant lawsuit to file a new lawsuit. The parties submit that this procedure is not most efficient and expeditious way to proceed to ensure that the interests of the parties and the court are best served. (Signed by Judge Debra C. Freeman on 9/20/04) (sac, ) |
