July 14, 2010 Opinion or Order Filing 295 ORDER PRELIMINARILY APPROVING SETTLEMENT: IT IS HEREBY ORDERED AS FOLLOWS: The Court preliminarily approves the Settlement Agreement as being fair, reasonable and adequate, subject to the right of any Class Member to challenge the fairness, reasonableness or adequacy of the Settlement Agreement and to show cause, if any exists why a final judgment dismissing this case and all released claims and awarding attorneys' fees and expenses to Class Counsel, should not be entered following a Final Fairness Hearing. The Class is certified for settlement purposes pursuant to Federal Rules of Civil Procedure 23(b)(2) and (b)(3) as set forth within this Order. Pursuant to Rule 23(g) of the Federal Rules of Civil Procedure, the Court appoints as Class Counsel, David Sanford, Esq., Katherine M. Kimpel, Esq., Steven L. Wittels, Esq., and Grant Morris, Esq., of Counsel, of SANFORD WITTELS & HEISLER, LLP to represent the Settlement Class for purposes of the Settlement. The Court hereby approves the substance, form and manner of the Notice of Proposed Class Action Settlement (the "Notice"), including the Claim Form, attached respectively, as Exhibits A and B to the Settlement Agreement. The Claims Administrator is directed to mail the Notice and Claim Form to the Class, pursuant to the Settlement Agreement following the entry of this Order, no later than September 9, 2010. Based on the deadlines set forth in the Settlement Agreement, a Final Fairness Hearing ("Settlement Hearing") shall take place on Friday, November 19, 2010 at the United States District Court for the Southern District of New York, United States Courthouse, Courtroom 14C, 500 Pearl St., New York, NY 10007, before the Honorable Colleen McMahon. A Claims Administrator will be appointed by Judge McMahon and shall perform the duties set forth in the Settlement Agreement. The Court orders that, pending Final Approval, each member of the Settlement Class is preliminarily enjoined from commencing, prosecuting or maintaining in any court other than this Court any claim, action or other proceeding that challenges or seeks review of or relief from any order, judgment, act, decision or ruling of this Court in connection with this Settlement Agreement. April 6, 2010 Opinion or Order Filing 284 RULING ON DAVID MOATAZEDI DEPOSITION TESTIMONY: Therefore, the inference plaintiffs would ask the jury to draw from the fact that Moatazedi was asked to do the ride along - namely, that Costa promoted his career because of their encounter - is not a permissible inference. If plaintiffs are able to muster any evidence that Mr. Costa ever said so much as one word to promote Moatazedi's career prospects, they should show it to me now. Alternatively, if they have evidence about Costa's practices in connection with ride alongs (i.e., did he always ride along with male representatives rather then female), they should show it to me to put this portion of the deposition into context. March 31, 2010 Opinion or Order Filing 280 ORDER CONCERNING TRIAL PROCEDURE: The Court is relieved to see that we are finally all on the same page (more or less) concerning what gets tried to the Court and what gets tried to the jury. Everyone now agrees that we will submit the issues of disparate treatment (pattern or practice discrimination), compensatory damages for the testifying named plaintiffs, and punitive damages for the class as a whole to the jury. If the jury concludes that defendant is liable for disparate treatment discrimination, the verdict sheet will direct it to answer YES or NO to a question regarding the propriety of an award of punitive damages. Evidence concerning Novartis' financial condition (to which I hope the parties can stipulate) will be submitted to the jury only if the answer is YES. Unless defendant can concretely identify some "additional evidence" not appropriately admitted in connection with the disparate treatment claims that the Court must hear before determining liability on a disparate impact theory, the Court expects all evidence relating to Novartis' liability under either theory to be presented during the jury trial. While the jury is deliberating, you will argue your respective disparate impact cases to me, based on the evidence previously admitted. Obviously I will await the jury's ruling on disparate treatment before ruling on disparate impact, but you will have your verdict on liability under a disparate impact theory within days after the jury's verdict on disparate treatment. Evidence relating to class-wide front and back pay awards for the class will not come in while the jury is in the box. However, that evidence will be heard while the jury is deliberating. The Court will render its verdict relatively quickly after the delivery of the jury's verdict on those claims that are triable to it. Potential claimants against those funds will have to make their case before a United States Magistrate Judge in a subsequent remedial phase. The Court will also refer any individual compensatory damages claims (for pain and suffering) to a United States Magistrate Judge for hearing following a period for notice and opportunity to opt out. In short, this Court intends to handle the entire trial except for the damages claims of non-testifying individual class members - liability under disparate treatment and disparate impact theories, compensatory damages to the testifying class members, punitive damages for the class, and class-wide back pay and front pay - in April and May 2010. I understand that this may lead to the introduction of unnecessary evidence during jury deliberations - for example, if the jury decides against the plaintiffs on their disparate treatment promotion claim and the Court decides against them on their disparate impact promotion claim, I will have heard evidence about back and front pay that I might not otherwise have needed to hear. However, my calendar does not permit me the luxury of postponing the portions of the trial that will result in verdicts delivered by the Court. I must move on to other matters come June 1. But they must be shown to your opponent before I will let the jury see them. 2. You can use electronic demonstratives in closing, not in opening.Deposition designations, objections thereto and counter-designations and objections thereto are all part of the Pre-Trial Order. Please understand that Plaintiffs will have time for a rebuttal case without reserving it-that is, the party with the burden of proof can put on a rebuttal case without counting it toward the eight trial days-but I will have to have a proffer on any proposed rebuttal evidence and will disallow it if it is not truly rebuttal. No more than think lots of deposition testimony is a waste of time and energy at a jury trial-but it is your call. Counts against your time. And please remember: no deposition testimony will be admitted from witnesses who testify (it ends up being duplicative, you can use inconsistent statements to impeach) or from witnesses who are within the court's subpoena power (I enforce this rules strictly, since I disfavor testimony by deposition at a trial). I do not sit on Fridays. We start as soon as I have all the jurors in the morning,but that is generally 9:45. I give one hour for lunch and I take a short break in the morning and in the afternoon. We end between 4:30 and 5 PM. The five weeks takes into account that Friday is my calendar day. This means your two weeks is a total of eight trial days.
