Filing 90 MEMORANDUM OPINION AND ORDER #97321 re: 54 PROPOSED MOTION for Summary Judgment filed by EMI Entertainment World, Inc., 66 CROSS MOTION for Summary Judgment filed by Karen Records, Inc., Karen Publishing, Inc. For the reasons stated herein and pu rsuant to F.R.C.P. 56(d)(1), the Court concludes that: (i) Karen acquired mechanical licenses for Cuando Acaba el Placer, Corazon Partio, and Fuiste Mia un Verano that lasted until November 25, 2004; (ii) Karen never acquired a mechanical license for La Colegiala; (iii) Sales of Mas Romantico and Bomba 2000 that occurred on or after January 14, 2009, infringed EMI's copyrights, provided that Karen did not pay EMI or Harry Fox a statutory royalty for those sales; and (iv) All sales of Grande s Exitos that occurred on or after January 14, 2009, infringed EMI's copyrights. The parties' motions for summary judgment 54 66 are granted in part and denied in part. The parties are directed to confer and submit a proposed scheduled for further submissions by 4/17/09.
