March 30, 2012 Opinion or Order Filing 102 OPINION & ORDER: re: 96 MOTION for Judgment. filed by John R. Ryan, Richard S. Smith, 98 MOTION for Judgment. filed by Sulaiman Oladokun. That Plaintiff is awarded nominal damages in the amount of one dollar ($1.00). ORDERED, that Defendan ts shall provide plaintiff with copies of his SUNY Maritime transcript upon payment of customary administrative fees. ORDERED, that Defendants shall provide a new Suitability Board Hearing when and if Plaintiff re-enters the United States and asks f or one by written request directed to the President of SUNY Maritime, 6 Pennyfield Avenue, Bronx, New York 10020. ORDERED, that if Plaintiff wishes to seek an award of costs and attorneys fees, Plaintiff shall submit a motion and briefing on the issue within thirty (30) days of the filing date of this Opinion and Order. September 27, 2011 Opinion or Order Filing 90 OPINION AND ORDER: For the foregoing reasons, the Court (1) GRANTS Plaintiff s request for equitable relief,in the form of an order compelling Defendants (a) to release official copies of Oladokun' s SUNY Maritime transcript upon the payment of customary administrative fees, and (b) to convene anew hearing, when and if Oladokun is able to re-enter the United States and request one; (2)GRANTS Plaintiffs request for leave to amend the Complaint to name Smith in his individual capacity; and (3 ) GRANTS Defendants' motion to dismiss the state-law claims against Ryan.The parties shall file a joint status letter by Friday, October 21, 2011, informing the court how they wish to proceed with this litigation. September 30, 2010 Opinion or Order Filing 77 OPINION AND ORDER: For the reasons stated above, the Court (1) DENIES Defendants motion on the issue of liability for failing to provide adequate notice and a hearing that comported with due process, and sua sponte GRANTS summary judgment in favor of Plaintiff on those issues (Plaintiffs Third Cause of Action); and (2) GRANTS Ryan's motion for summary judgment on the issue of his individual liability for failing to conduct a substantive, pre-appeal review of Plaintiffs disenrollment decisio n, and DENIES Plaintiffs motion for summary judgment on that issue (Plaintiffs First Cause of Action). The parties shall, within three weeks of the issuance of this Opinion & Order, submit to the Court a joint letter specifying: (a) the relief reque sted by Plaintiff, and the legal or equitable bases for such relief; (b) Defendants' response to Plaintiffs requested relief; and (c) a proposed schedule for any necessary motions or briefing related to the foregoing. March 31, 2009 Opinion or Order Filing 45 OPINION AND ORDER #97375: For the reasons set forth in this order, plaintiffs motion for leave to amend is Granted. Plaintiff is instructed to: (1) state a specific theory or theories of Defendant Ryan's personal involvement under Section 1983; and (2) allege facts, which, if proven, would establish personal involvement under those theories. Defendant Ryan's motion for summary judgment on the individual liability claims against him is DENIED without prejudice to refile after the concl usion of discovery (D. E. 35). No later than Friday, April 17, 2009, Plaintiff shall file his Amended Complaint. No later than Friday, May 15, 2009, Defendant Ryan shall file his Amended Answer. The parties shall conclude discovery no later than Fri day, August 7, 2009. The parties are reminded that, pursuant to the Court's Order dated January 17, 2008, the case has been referred to Magistrate Judge Kevin Nathaniel Fox for general pretrial and discovery management.
