September 30, 2010 Opinion or Order Filing 68 MEMORANDUM OPINION & ORDER ADOPTING REPORT AND RECOMMENDATIONS: Conclusion: For the foregoing reasons, the Court accepts and adopts the Report and Recommendation as its opinion. Defendants' motion for summary judgment is GRANTED and the case is DISMISSED. The case is frivolous and has burdened the scarce resources of this Court for too long. Any appeal from this Order would also waste the Second Circuit's scarce resources as well. Pursuant to 28 U.S.C. § 1915(a), an appeal would not be taken in good faith.
