Filing 68 MEMORANDUM OPINION & ORDER ADOPTING REPORT AND RECOMMENDATIONS: Conclusion: For the foregoing reasons, the Court accepts and adopts the Report and Recommendation as its opinion. Defendants' motion for summary judgment is GRANTED and the case is DISMISSED. The case is frivolous and has burdened the scarce resources of this Court for too long. Any appeal from this Order would also waste the Second Circuit's scarce resources as well. Pursuant to 28 U.S.C. § 1915(a), an appeal would not be taken in good faith. The Clerk of Court is directed to enter judgment accordingly. (Signed by Judge Paul A. Crotty on September 30, 2010) Copies Mailed By Chambers. (mov) |
