Filing 72 MEMORANDUM OPINION AND ORDER:#98115 For the reasons stated above, defendants motions for summary judgment 66 are granted. Simatelexs motion to dismiss for lack of personal jurisdiction 65 is denied as moot. Sunbeams counterclaim for declaratory j udgment of the invalidity of the 585 patent, which Sunbeam does not mention in its motion papers, is dismissed without prejudice. See Liquid Dynamics v.
