August 31, 2009 Opinion or Order Filing 175 OPINION AND ORDER:#97974 Defendants' Motion for Summary Judgment is denied, and Plaintiffs' Motion for Summary Judgment is granted. Plaintiffs' Motion to Exclude is denied as moot. As Defendants have conceded infringement of Plaintiffs ' '392 and '812 reissued patents, this Court finds that Plaintiffs are entitled to a permanent injunction prohibiting Defendants from further infringement. 35 U.S.C. 271 (e)(4)(B). Accordingly, judgment will be entered in favor of Plai ntiffs. Defendants are hereby permanently enjoined from engaging in any activity that infringes on U.S. Patent No. 6,440,392, inclusive of U.S. Patent Number RE40,812. (Signed by Judge Robert P.
