If non-compliance continues after Ma y 15, 2018, the Court will consider imposing further coercive measures, up and including civil confinement. Although Plaintiff contends such drastic measures are "unthinkable" (see ECF 389), they may be necessary in light of Plaintiff 9;s lengthy, deliberate intransigence. The Court has inherent power to impose such measures to coerce compliance with its orders. See Armstrong v. Guccione, 470 F.3d 89 (2d Cir. 2006). December 18, 2017 Opinion or Order Filing 365 OPINION & ORDER. This Court GRANTS the Columbia's application and DENIES the Raghavendra's request for a permission to file his motions. The Court approves the above-identified adjustments as the Court finds them reasonable and in complian ce with the Court's outstanding orders as further set forth in this Opinion. The Court DIRECTS Raghavendra to execute the revised settlement agreement in Case No. 06 Civ. 6841, ECF 363-1 by January 2, 2018. Raghavendra requests permission to f ile motions to (1) reconsider a stay of the December 1, 2017 Order pending his appeal to the Second Circuit and (2) unseal the 2009 settlement documents. See Case No. 06 Civ. 6841, ECF 362. The request is DENIED. Therefore, the Court finds no comp elling reason to permit Raghavendra to file motions to (1) reconsider a stay of the December 1, 2017 Order pending his appeal to the Second Circuit and (2) unseal the 2009 settlement documents. Rag havendra must: (1) execute, by January 2, 2018, (a) a general release submitted to this Court in Case No. 06 Civ. 6841, ECF 144; or, alternatively, (b) upon Columbia's application due on December 10, 2017 and subject to this Court's approv al, a general release of all claims against all defendants substantially similar to the release submitted to this Court in Case No. 06 Civ. 6841, ECF 144; and (2) withdraw with prejudice, by December 18, 2017, the Eastern District of New York action, Case No. 2:16 Civ. 4118 (E.D.N.Y.). Failure to comply with either (1) or (2) shall trigger a fine of $1,000 per day for each day Raghavendra is in non-compliance. Failure to comply with both (1) and (2) by January 31, 2018 shall result in an increased fine of $5,000 per day for each day Raghavendra is in non-compliance after January 31, 2018. If Raghavendra fails to comply with both (1) and (2) by February 28, 2018, the Court reserves its right to impose further coercive measures , up and including civil confinement until compliance has been achieved. 2. Raghavendra must not submit any Prohibited Document as defined herein using the federal court's filing system without prior approval by this Court. If Raghavendra viol ates this order, the Court shall find Raghavendra in contempt of court and impose $5,000 in civil fine per day until the Prohibited Document is withdrawn or stricken. 3. Raghavendra must not file any action against Columbia, Stober, and their attorneys related to the subject matter of Case Nos. 06 Civ. 6841, 08 Civ. 8120, 09 Civ. 0019, and 17 Civ. 4480 in any federal or state court. If Raghavendra violates this order, the Court shall find Raghavendra in contempt of court and impose &# 036;5,000 in civil fine per day until the newly filed action is withdrawn or dismissed. 4. Stober shall identify, via a letter to the Court by December 31, 2017, ECF docket entries that include papers with ad hominem attacks. 5. Stober is authorize d to retain, from the settlement proceeds, one-third of the settlement proceeds in legal fees, less a credit of $10,000.00. 6. Columbia shall identify, via a letter to the Court by December 31, 2017, ECF docket entries that include documents w ith accusations of criminal conduct. The Clerk of the Court for the Southern District of New York is directed not to accept from Raghavendra any Prohibited Document, as defined herein, using the federal court's filing system, such as the Court's ECF system. The Clerk is directed to close all pending motions in Case Nos. 06 Civ. 6841, 08 Civ. 8120, 09 Civ. 0019, and 17 Civ. 4480. SO ORDERED. (Signed by Judge Paul A. May 28, 2014 Opinion or Order Filing 272 ORDER: Plaintiff Randy Raghavendra moves for reconsideration of the Court's April 15, 2014 Order holding him in contempt of court. (See Dkt. 262.) After filing this motion, Raghavendra filed a notice of appeal of the Order. Raghavendras motio n does not cite any new evidence or an intervening change in controlling law, but rather it rehashes his prior arguments on matters that have already been decided. April 15, 2014 Opinion or Order Filing 262 ORDER: For the foregoing reasons, Raghavendra's motion to declare him in compliance with the December 20, 2013 Order is DENIED. Stober's cross-motion is GRANTED IN PART, insofar as the Court holds Raghavendra in CONTEMPT. The Court reserv es the question of sanctions for the conclusion of this litigation, i.e., the exhaustion of Raghavendras appeals in state court. The Court also retains jurisdiction over these cases. February 19, 2010 Opinion or Order Filing 149 ORDER: The Court ADOPTS Magistrate Judge Pitman's R&R in its entirety and upholds the Settlement Agreement. The Court GRANTS Stober's motion to strike immaterial or impertinent matter on its docket and directs the Clerk of Court to strike t he following documents: In the 06 Civ. 6841 action: Docket #'s: 107-08; 114-15; 121; 124; 127; 130-34; In the 08 Civ. 8120 action: Docket #'s: 61; 68-69; and In the 09 Civ. 0019 action: Docket #'s: 45-46 The Court further ORDERS Raghav endra to cease filing papers containing immaterial and inappropriate statements and ad hominem remarks about Stober. Further, the Court exercises its supplemental jurisdiction over the Fee Dispute and finds that the Retainer is valid and enforceable. Finally, the Court finds that Stober has earned an award equal to 1/3 (33.33%) of the monies which Columbia agreed to pay to settle the dispute. Pursuant to the Settlement Agreement, Raghavendra must tender to Columbia properly executed "d ocuments that are necessary to accomplish withdrawal" of all claims; he must tender to Columbia release of all claims against all defendants in all actions and the EEOC Charge; and he must tender any and all documents reasonably demanded by defe ndant Columbia and end this matter. Upon presentation of such documents, Columbia must pay the settlement amount, as stated in the July 30,2009 Settlement Agreement, "less applicable taxes and withholding as wages". Such payment should be m ade to Louis D. Stober, Jr. as attorney, who may deduct the fee specified in the Retainer and remit the balance to Raghavendra. The Clerk of the Court is directed to close as moot all pending motions in the three above-referenced cases (06 Civ. 6841; 08 Civ. 8120; 09 Civ. 0019). SO ORDERED. (Signed by Judge Paul A.
