Plaintiffs National Football League Players Association, INc. and National Football League Players Incorporated alleges that defendant Comercial LT Baroda S.A. d/b/a BetUS promotes the sportsbook feature of its gambling enterprises by making extensive and unauthorized use of photographs, names, and likenesses of several professional football players in the NFL on the BetUS website and in its marketing materials.

AGREED ORDER: IT IS ORDERED this 9th day of October 2007 that: Defendants Comercial LT Baroda S.A. d/b/a BetUS, and Commercial L.T. Baroda (Canada) Ltee, their former and current agents, representatives, employees, officers, directors, affiliates, subsidiaries, parents, divisions, shareholders, predecessors, successor, and assigns, and all persons in active concert or participation with any of the foregoing, are permanently enjoined from using six (6) or more NFL players' names, numbers, likenesses, pictures, photographs, voices, facsimile signatures and/or biographical information in any way, including but not limited to, in connections with the operation of BetUS's and CLTB's websites and the distribution of promotional materials, provided that the party making such use does not have Plaintiffs' prior, express, signed permission therefor; and this Court shall retain jurisdiction for the purpose of enforcement of this matter.
