Filing 64 ADOPTION OF REPORT AND RECOMMENDATION for 57 Motion for Summary Judgment filed by NYC Department of Homeless Services, 61 Report and Recommendations. The Court reviews the remainder of the Report for clear error. Having found no clear error on t he record with the remainder of the Report, and having conducted an independent de novo review of the specifically objected-to portions of the Report, is ORDERED as follows: (1) The Report and Recommendation of United States Magistrate Judge Fox date d September 24, 2009, be and the same hereby is, APPROVED, ADOPTED, and RATIFIED by the Court. (2) Defendant's Motion for Summary Judgment is GRANTED. Plaintiff's Title VII claim is DISMISSED, with prejudice. Filing 61 REPORT AND RECOMMENDATIONS: For the reasons set forth above, I recommend that the defendants motion for summary judgment, Docket Entry No. 57, be granted. I recommend further that the court decline to exercise its supplemental jurisdiction authority over the plaintiffs City Human Rights Law claim. Failure to file objections within ten days will result in a waiver of objections and will preclude appellate review.
