MEMORANDUM & ORDER denying 89 Motion for Summary Judgment. For the foregoing reasons, QKF's motion for summary judgment is denied. The court is aware that prior settlement negotiations have been unsuccessful. Parties are directed to submit a pretrial order within six weeks hereof advising the Court when they will be ready for trial, unless, that is, parties would be amenable to some other form of dispute resolution. OPINION AND ORDER: Accordingly, QKD and QKF's motion is granted to the extent they seek to file an amended third-party complaint alleging (1) breach of contract and breach of warranty claims against J&H (2) claims against J&H and Schmeltzer for equitable contribution and equitable indemnity., (3) a claim against J&H and Schmeltzer for a declaratory judgment and (4) a claim against J&H and Schmeltzer for contribution and indemnity with respect to the common law unfair competition claims asserted against QKD or QKF.
