February 25, 2010 Opinion or Order Filing 45 MEMORANDUM OPINION AND ORDER: #98606 Plaintiff is correct to note that Ms. Chou has not been subject to cross examination and may have a remote interest in the outcome of the litigation insofar as MetLife is a regular customer of her client, Portamed ic. (Lin. Mem. 12.) But plaintiff.had the opportunity to depose Ms. Chou and failed to do so. Thus, there is little force to plaintiffs objection that the record is one-sided. MetLife's motion for summary judgment 21 is granted. Because the Court has not rel ied on the testimony of Drs. Zamarippa and Clain for any purpose within Federal Rule of Evidence 702, plaintiff's cross-motion in limine 32 is denied as moot.
