Filing 24 MEMORANDUM AND ORDER. ADOPTING REPORT AND RECOMMENDATIONS for 20 Report and Recommendations. For the foregoing reasons, this Court adopts Magistrate Judge Gorenstein's March 22, 2011 report and recommendation in its entirety. Petitioner Jamal Petty's petition for a writ of habeas corpus is denied. Because Petty has not made a substantial showing of the denial of aconstitutional right, a certificate of appealability will not be issued. 28 U.S.C. § 2253( c). In addition, this Cou rt certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith. See Coppedge v. United States, 369 U.S. 438 (1962).
