March 31, 2009 Opinion or Order Filing 53 OPINION AND ORDER #97359 re: 37 MOTION to Dismiss. filed by Luigi Pagano, Ralph Perfetto, Christopher Newsom, Michael McGovern, John Adriano, Jordan Bistany, The City of New York, Joseph Bonner, Liz Salinas, Dennis Morgano, Bryan Hanson. The City D efendants' November 3, 2009 motion to dismiss and for summary judgment against plaintiff's 1983 and 1985 claims is granted, except that it is denied with regard to plaintiff's claim for municipal liability based on the use of excessive force in violation of 1983. Plaintiff's state law claims for relief under the New York Human Rights Law and New York Administrative Code are dismissed against the City Defendants. A conference will be held with the parties to discuss the schedule for the remainder of the litigation and the issue of supplemental jurisdiction over the remaining state-law claims.
