Filing 159 MEMORANDUM OPINION AND ORDER Plaintiff, Ho Myung Moolsan (Moolsan), a South Korean mineral water reseller, brought this breach of contract action against defendant Manitou Mineral Water (Manitou), a mineral water manufacturer based out of Colorado an d New York. At trial ending November 1, 2010, a unanimous jury returned a verdict for defendant on liability for all claims. This opinion sets forth the Courts reasoning for the following rulings made before and during trial. The Court thus disposed of the issues presented above for the reasons stated above. SO ORDERED. Filing 92 OPINION AND ORDER:#98098 Accordingly, for all the foregoing reasons, plaintiffs' motion to for leave to amend the complaint (Docket Item 64) is granted insofar as it seeks to include a claim for breach of fiduciary duty through conspiracy agains t Manitou Springs and Kwon and denied in all other respects. With respect to Defendants' Motion for Sanctions, although I find that plaintiffs violated Fed.R.Civ.P. 11 (b) (Docket Item 79), I decline to impose sanctions under Fed.R.Civ.P. 11(c) and the motion is denied.
