April 21, 2010 Opinion or Order Filing 65 DISCOVERY PROTOCOL 1: On or before March 11, 2010, Moody's shall begin producing documents from document categories 5-20 in the Regulatory Productions as defined in the Rule 26(f) Order. Categories 5-20 are set forth in the January 19, 2010, let ter from Sharon L. Nelles. Production of document categories 5-20 shall proceed on a rolling basis until completion. Moody's has represented that it can complete production on or before May 10, 2010. On or before May 28, 2010, or the next busine ss day after Moody's serves its memorandum in opposition to plaintiffs' class certification motion, Moody's shall begin preparing to produce documents from categories 1-4 and 21 in the. Regulatory Productions. Production of document c ategories 1-4 and 21 shall proceed on a rolling basis until completion. If Moody's has not completed production of these materials within 120 days of service of papers in support of its opposition to class certification, then Moody's shall provide the Special Master and plaintiffs with a report indicating the progress of production and an estimated completion timeline. February 23, 2009 Opinion or Order Filing 35 OPINION AND ORDER:# 97128 Defendants motion to dismiss the AC is granted in part and denied in part. The first count of the AC is dismissed in its entirety with respect to defendants Clarkson and Kanef. Count I is also dismissed with respect to defen dants McDaniel and Moodys insofar as it rests on statements regarding the meaning of Moodys ratings and the source of the Companys structured finance revenue. The second count of the AC is dismissed insofar as it asserts claims against Kanef and Clar kson. Plaintiffs' second amended complaint, along with a memorandum explaining how their amendments have cured the defects specified herein by the Court, shall be filed on or before March 18, 2009. Defendants' memoranda in opposition to Pl aintiffs' further amended complaint shall be filed on or before April 15, 2009. Plaintiffs' reply memorandum shall be filed on or before April 29, 2009.
