No. 263), defendant Jamie Gomez requests a copy of the criminal docket sheet showing the status of his pending Fed. R. Civ. P. 59(e) motion filed in July 2021. Defendant, however, has no pending motio ns. The Court has also examined his civil docket, 08 Civ. 171 (DC), and found no pending motions there. If Mr. Gomez would like the Court to consider the Rule 59(e) motion, he shall promptly mail to the Court a copy of the motion as well as proof of service and mailing in July 2021. June 24, 2021 Opinion or Order Filing 9 MEMORANDUM DECISION & ORDER: For the reasons set forth above, Gomez has failed to show a basis for relief under 28 U.S.C. § 2255. Accordingly, his petition for relief is denied. Because he has not made a substantial showing of the denial of a constitutional right, I decline to issue a certificate of appealability. See 28 U.S.C. § 2253 (1996) (as amended by the Antiterrorism and Effective Death Penalty Act). I certify pursuant to 28 U.S.C. § 1915(a)(3) that any appeal taken from this order would not be taken in good faith. The Clerk of the Court shall enter judgment accordingly, close case number 16- CV-5584, and send a copy of this Order to Gomez at the address provided above. July 30, 2009 Opinion or Order Filing 5 OPINION: Pro se defendant Jaime Gomez moves to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. § 2255 on the ground that he was denied effective assistance of counsel in violation of the Sixth Amendment of the United States Cons titution when he was convicted of conspiracy, murder, and narcotics charges. For the reasons set forth above, the defendant has failed to demonstrate any basis for relief under 28 U.S.C. § 2255. The motion is therefore denied. Because Gomez has not made a substantial showing of the denial of a constitutional right, I decline to issue a certificate of appealability. See 28 U.S.C. § 2255 (1996) (as amended by the Antiterrorism and Effective Death Penalty Act).
