OPINION: For the foregoing reasons, P&Es motion for summary judgment is denied, and Millbrooks motion for summary judgment is granted dismissing P&Es claim of breach of contract by failure to reimburse extraordinary expenses. If UNFI wishes to pursue summary judgment on P&Es claim of tortious interference with contract, that motion should be presented in a separate notice of motion with a supporting brief.
