Filing 50 OPINION AND ORDER re: 37 MOTION for Summary Judgment filed by Department of Correctional Services, Ronald J. Haines, New York State, Joseph Williams, George Van Valkenburg, Salvatore Munafo, Nicholas Brocco and Robert Murray: The Court has conside red all of the arguments of the parties. To the extent not specifically addressed within, the remaining arguments are either moot or without merit. For the foregoing reasons, the defendants' motion for summary judgment is granted with respect to the plaintiff's § 1983 equal protection claim but denied with respect to the plaintiff's Title VII discrimination and retaliation claims.
