MEMORANDUM OPINION AND ORDER. Plaintiff's motion to dismiss under Rule 41(b) is denied. Pursuant to Rule 4(m) of the Federal Rules of Civil Procedure, Plaintiff is ordered to personally serve the Actonel Defendants with the complaint within 14 d ays of the date of this Order. The parties are directed to appear by telephone for a status conference on November 9, 2016, at 11:00 A.M., to discuss the possibility of resolving this case before remand.
