June 30, 2009 Opinion or Order Filing 40 DECISION AND ORDER: For the reasons stated above, Defendants' motion to dismiss [#34] is granted in part and denied in part. Plaintiffs' claims against Greene and Carbone under section 1983 for false arrest and malicious prosecution and sta te law claims for malicious prosecution, abuse of process, loss of consortium, and negligence/gross negligence may proceed to discovery. Plaintiffs' claims against the City alleging municipal liability may proceed. Plaintiffs' claims again st DA Morgenthau and former ADA Quinn are dismissed. The parties are directed to participate in a status/settlement conference on Wednesday, August 12, 2009, at 9:00 a.m., in Courtroom 21B, 500 Pearl Street, New York, New York.
