Filing 90 OPINION AND ORDER: re: 65 MOTION for Summary Judgment. filed by Microsoft Corporation, 77 MOTION for Summary Judgment. filed by Alson Alston. Plaintiff has failed as a matter of law to demonstrate that he would be entitled to prevail on his wrong ful termination claims. To the contrary, he has failed to present evidence of any genuine dispute of material fact that could allow a reasonable fact finder to find in his favor. Accordingly, this Court denies plaintiffs motion for summary judgment and grants defendant's motion for summary judgment. (Signed by Judge Sidney H. Stein on 3/27/2012) (jfe) |
