Filing 90 ORDER ON MOTION OF DEFENDANT ALLIED WORLD ASSURANCE COMPANY (U.S.), INC. FOR LEAVE TO AMEND ANSWER TO ASSERT COUNTERCLAIM: I have reviewed the papers submitted in support of and in opposition to this motion. I heard oral argument on November 4, 2009. I have also considered the post-argument submissions of the parties. Attached hereto are the Joint Findings of Fact, which I adopt. I also adopt the Proposed Conclusions of Law submitted by the plaintiffs-insureds, which are also attached. The moti on is DENIED. Finally, I reject the moving party's argument that the plaintiffs-insureds be required to post a bond pending appeal. I have no basis to conclude that a bond is necessary to protect the moving party's rights. (Signed by Ronald J. Hedges, Special Master, on 11/20/2009) (jpo) |
Filing 79 OPINION AND ORDER Accordingly, the insureds' motion for reconsideration is denied. XL's motion for reconsideration is granted, but on reconsideration XL's motion for summary judgment is again denied. SO ORDERED. (Signed by Judge Gerard E. Lynch on 5/29/2009) (jmi) |
Filing 70 ORDER: Accordingly, it is hereby ordered that the accompanying copy of the correct text of the Court's opinion be docketed and provided to the parties, to replace the previous version of the Opinion. (Signed by Judge Gerard E. Lynch on 4/30/2009) (jpo) |
