ORDER denying 78 Motion to Dismiss for Lack of Jurisdiction. The motion to cancel the mark and to dismiss this action is therefore denied. The Court thus declines to exercise its discretion to award the fees and protective order sought by USR. If S ecure USA initiates further litigation relating to the subject matter of this action or settlement thereof, however, the Court may consider whether such relief would be warrranted.
