May 26, 2010 Opinion or Order Filing 52 MEMORANDUM AND ORDER terminating 43 Motion ; terminating 46 Motion. The plaintiff is HEREBY ORDERED to provide the defendant, on or before 6/11/2010, with the information and all documents sought via the Schedule A list. The plaintiff is advised that any information or documents she fails to provide may not be used, by her, as evidence in support of any motion, at a hearing or at trial. Moreover, to the extent the plaintiff did not respond properly to particular interrogatories and document s demands, not on The Schedule A list, the plaintiff is precluded from using those witnesses or documents as evidence on any motion, at a hearing or at trial. The plaintiff is FURTHER ORDERED to attend a deposition, by the defendant, in New York, NY , on a date of the defendant's choosing, on or before 6/25/2010. This order serves as the plaintiff's final warning that failure to comply with the Court's orders will result in a report and recommendation to the assigned district jud ge that her action be dismissed, with prejudice. Anything short of full compliance with this order- including adherence to the firm deadlines set- will be deemed a failure to comply, warranting such a report and recommendation. July 27, 2009 Opinion or Order Filing 33 MEMORANDUM AND ORDER: The Court determined that, at this juncture, a sanction other than dismissal can be employed beneficially. The defendant's motion is granted to the extent that, as a sanction, on or before 8/14/09, Crawford-Bey shall pay t o the Clerk of Court $200.00 for her failure to obey court orders and meet her discovery obligations, which has resulted in unnecessary and unjustified delay in the progression of this litigation. The Court will not require the plaintiff to pay the defendant the reasonable expenses, including attorney's fees it incurred, resulting from the plaintiff's failure, based on Crawford-Bey's representation to the Court that she is unemployed. Should the plaintiff fail to comply wit h this order, a Report and Recommendation will be made to the assigned district judge that this action be dismissed. For the reasons set forth herein, the defendant's motion, made pursuant to Fed. R. Civ. P. 37(b) and (d), Docket Entry No. 27, is granted to the extent noted above.
