Filing 45 OPINION and ORDER. #98050 For the reasons set forth above, the Court Grants Supervisor-Defendants' motion to dismiss Plaintiffs' claims under NYHRL section 296. The Court grants Defendant Superintendent's and Defendant -District' ;s motion to dismiss all claims against them. The Court grants Defendant-Principal's motion to dismiss Plaintiffs' claims for vicarious liability and violation of NYRL section 296, to dismiss Plaintiff-Parents' claims for violation of 42 U.S.C. section 1983, negligence, and negligent infliction of emotional distress, and to dismiss all Plaintiff-Childrens claims for negligence, except the claim of Plaintiff "FA". The Court Denies Defendant-Principal's motion to dis miss Plaintiff-Children's claims for violation of 42 U.s.C. section 1983 and negligent infliction of emotional distress, and Plaintiff "FA"'s claim for negligence. The Court grants plaintiffs leave to amend the following claims a s set forth herein. Any amended complaint shall be filed by October 6, 2009; The Court orders the parties to submit a jointly agreed upon discovery plan and scheduling order no later than October 20, 2009. No later than November 1, 2009, the parties shall submit a joint letter to the Court detailing their available dates in November 2009 for a case management conference. (Signed by Judge Kimba M.
