Filing 93 MEMORANDUM & ORDER granting in part and denying in part 88 Motion in Limine: Defendants' motion is granted with respect to motions and exhibits from the LOA litigation and denied with respect to testimonial references thereto. This Court will consider Defendants' requests for appropriate limiting instructions. For the reasons stated above, it is hereby ORDERED that Defendants' motion in limine to exclude Plaintiffs' Proposed Exhibit 2 to exclude motions and exhibits from the LOA litigation is GRANTED. Filing 52 OPINION AND ORDER: For the reasons set forth herein, the Court denies Defendants motion for summary judgment on Plaintiffs Title VII, retaliation, and hostile work environment claims only to the extent noted above. Defendants motion for summary judgm ent on Plaintiffs § 1981 and § 1983 claims are granted with respect to Defendant City of New York and the individual Defendants sued in their official capacities and denied with respect to the Defendants sued in their individual capacities. Plaintiffs § 1985 claims are dismissed as to all Defendants. All claims against the NYPD are dismissed. The parties are to consult with each other concerning the future progress of this litigation. Should the parties find it useful, the Court w ill favorably entertain an agreed motion to refer the case to mediation or to pursue other forms of resolution.
