Filing 30 MEMORANDUM AND ORDER: For the foregoing reasons, Plaintiff's motion for summary judgment is granted with respect to its trademark infringement claim under IS U.S.C. § 1114(1) (First Claim for Relief), false designation of origin claim under 15 U.S.C. § 1125(a) (Second Claim for Relief), federal trademark dilution claim under 15 U.S.C. § 1125(c) (Third Claim for Relief), trademark infringement and unfair competition claims under New York common law (Fourth Claim for Relief), a nd trademark dilution claim under New York General Business Law Section 360-1 (Fifth Claim for Relief). Plaintiff's motion for summary judgment is denied with respect to its deceptive acts and practices claims under New York General Business Law Sections 349(a), 350 and 350-a (Sixth Claim for Relief). Plaintiff's application for an award of reasonable attorney's fees under 15 U.S.C. § 1117(a) is granted.
