Filing 90 ORDER denying 56 Motion for an Order under Title 28 U.S.C. 1292(b) for Certification for Interlocutory Appeal of this Court's October 13, 2010 Memorandum and Order re: 51 Order on Motion to Dismiss ; denying 57 Motion for Reconsideration r e 51 Order on Motion to Dismiss ; granting in part and denying in part 60 Motion for Reconsideration re 51 Order on Motion to Dismiss. Plaintiffs motion for reconsideration is denied. Defendants' motion for reconsideration is granted with respect to Plaintiffs Eleventh, Twelfth, Thirteenth, Fourteenth, Fifteenth, Sixteenth, Seventeenth, Eighteenth, Nineteenth, Twentieth, Twenty-Second, Twenty-Third, Twenty-Fifth, and Twenty-Sixth Claims, which are dismissed, and denied with respect to Plaintiffs other claims. Plaintiff has withdrawn his Seventh, Eighth, and Twenty-Fourth Claims. The City Defendants remain dismissed as parties to this action. Plaintiffs motion to certify this Court's Order of October 13, 2010 for interlocutor y appeal to the United States Court of Appeals for the Second Circuit is denied. Plaintiff is granted leave to amend the Complaint solely to substitute Defendant Best Buy Stores, L.P. for incorrectly named Defendants Best Buy Co., Inc. and Best Buy Co. of Minnesota.
