OPINION & ORDER: Accordingly, the Court finds that the recent amendments to section 292 in the America Invents Act eliminate plaintiff's standing to bring this action and leave him with no claim to relief on the merits. In addition, the retroact ive application of amendments does not violate the U.S. Constitution's separation of powers.
