MEMORANDUM OPINION AND ORDER: For the reasons so forth on this opinion, the petitioner's motion to vacate or set aside his conviction and sentence pursuant to 28 U.S.C. § 2254 is denied. The petition is therefore dismissed. The clerk is dir ected to enter judgment dismissing the petition, closing this case, and closing all pending motions. Because the petitioner has failed to make a substantial showing of the denial of a constitutional right the Court declines to issue a certificate of appealability pursuant to 28 U.S.C. §2253(c). MEMORANDUM OPINION AND ORDER:#97680 The petitioner has not shown that his claim is likely to be of substance. Therefore, the application for appointment of counsel (Docket NO.4) is denied without prejudice. The petitioner has also filed a motion for an evidentiary hearing (Docket No.5). The respondent should respond to that motion by July 15, 2009, together with the response to the petitioner for a writ of habeas corpus pursuant to 28 U.S.C. 2254.
