February 15, 2012 Opinion or Order Filing 295 TRIAL PROCESS ORDER #3: Having reviewed the parties' witness lists, deposition designations, expert reports and proposed documentary exhibits, the Court ORDERS the following: 1. Cumulative testimony shall not be allowed. The parties shall pick their witnesses (whether live or by deposition) and best documents on particular topics. 2. Opening statements shall be limited to no more than 45 minutes per side. 3. Any deposition designations from a single witness-both affirmative and counter- designations-shall be read at one time in the order that they appear in the transcript (with no statement as to which side has designated or counter designated the testimony). All objections of counsel shall be deleted-i.e. not read to the jury. 4. The parties are expected to put documents into evidence through appropriate witnesses. A lack of objection, or overruled objection, does not eliminate the need to authenticate properly each document before the jury. (The Court will not allow lengthy publication of documents to the jury in the absence of appropriate witnesses.) 5. There are numerous exhibits which may be used for cross-examination but are not admissible as affirmative "evidence." The parties should not consider the Court's rulings on objections to proposed exhibits to preclude use of those exhibits on cross-examination. Exhibits related to topics precluded under Rule 403, however, will not be permitted on either direct or cross. Any questions about the foregoing will be addressed at the final pretrial conference. 6. Expert reports will not be admitted, even if neither party objects. They are classic hearsay. 7. The parties seek to "admit" documents relied on by the experts. By February 2, 2012, the parties shall submit a joint letter a. indicating the method by which any witness will testify by deposition: Via videotape or reading. If reading, please confer with opposing counsel on the method and manner of reading and indicate the agreed-to method and manner in the joint letter. All voice "inflection" and "acting-type" affectations must be avoided. b. defendants shall also state in the letter whether Mr. Powers will be testifying as an expert witness. R. Civ. P. 53, appoint Mr. Don W. Martens as a special master to make recommendations to the Court with respect to any specific motions involving patent issues referred to Mr. Martens by the Court. It is ORDERED, ADJUDGED and DECREED as follows: Don W. Martens is hereby appointed as a special master in this case pursuant, to Fed. R. Civ. P. 53, to make recommendations to the Court with respect to any specific motions involving patent issues referred to Mr. Martens by the Court. Prior to referring any summary judgment motion to the Special Master, the parties shall, consistent with the individual practices of Judge Marrero, send a letter to the Court concisely describing the basis for the proposed motion and requesting a pre-motion conference.
