DECISION AND ORDER: For the foregoing reasons, Movants' partial motion to dismiss [#8] is granted and Plaintiffs motion for a preliminary injunction [#11] is denied. The parties are directed to appear at a status/settlement conference with the Court on January 4,201 0 at 10:OO a.m. in Courtroom 21B of the Daniel Patrick Moynihan Courthouse, 500 Pearl Street, New York, New York 10007. The conference scheduled for December 17, 2009 is vacated. The Court directs the parties to engage in good faith settlement negotiations prior to the conference with the Court.
