June 9, 2014 Opinion or Order Filing 107 ORDER: By letter dated June 6, 2014, Merck requests leave to file a motion for a new Lone Pine order, this one targeted toward plaintiffs who have not elected to participate in the pending settlement. Merck represents that many of these plaintiffs "have not responded in any way to attempts of their counsel to communicate." The Plaintiff's Steering Committee has advised that it does not oppose Merck's request, and will not oppose the ultimate motion for a Lone Pine order. The Court grants Merck leave to file the contemplated motion. The motion should be made by Wednesday, June 11, 2014, and notice of the motion should be served to the attorneys of the affected plaintiffs on that date. The motion should include example Lone Pine orders from other actions where the court entered the order for the purpose Merck recommends here, i.e., as a prelude to the dismissal of unresponsive plaintiffs during settlement. It should also include a list of all plaintiffs to whom the contemplated Lone Pine order would apply, and their attorneys of record. Counsel for those affected plaintiffs are directed to respond, whether they oppose the motion or not, by Wednesday, June 18, 2014. Where a plaintiff's attorney represents that he or she has been unable to reach a plaintiff, the response should set forth precisely what steps have been taken to locate those plaintiffs and communicate with them regarding participation in the settlement. October 3, 2013 Opinion or Order Filing 102 ORDER. The Court has reviewed the letters submitted by Defendant Merck and the Plaintiffs' Steering Committee ("PSC") regarding the Remand Order of August 29, 2013. The Remand Order is amended as follows: Unless a settlement has been reached, the Court's first order suggesting remand will be entered on December 2, 2013, with subsequent orders to be entered on the first business day of the month thereafter until the process is complete. In cases that were filed directly in this District and therefore must also be transferred, the following process is ordered: The PSC will submit a letter detailing the preferred venue of the plaintiffs no later than three weeks before the Court's suggestion of remand will be entered. For the first batch of cases, the letter is due November 11, 2013. This letter must be consistent with the process set forth in the Remand Order that is, beginning with the oldest cases plus Sargent v. Merck, 06 Civ. 5086. Any alternative "particularized venue application" will be considered separately and the PSC may not present it in a manner that would delay the remand further should the application be denied. Merck should review the venue suggestions, and must notify the Magistrate of any objections no later than two weeks before this Court will enter the suggestion of remand. For the first batch of cases, these objections will be due by November 18, 2013. As before, any disputes relating to venue selection will be resolved by Magistrate Judge Francis. August 29, 2013 Opinion or Order Filing 99 ORDER: The Court has reviewed the letters submitted by counsel for Generic Defendants and the Plaintiffs' Steering Committee ("PSC") regarding Generic Defendants' request for an extension of time. It is hereby ORDERED that the deadline for Defendants Teva Pharmaceuticals USA, Inc., Watson Pharmaceuticals, Inc., and Watson Laboratories, Inc., to answer or otherwise respond to the complaints is extended to September 30, 2013. The PSC correctly points out that that Federal Rule of Civil Procedure 12(g) (2) precludes the Generic Defendants from making a Rule 12 motion that was available to them at the time they made their motion under Rule 12(c). Generic Defendants have represented, however, that the motion was not available to them at the time of their Rule 12(c) motion. Without resolving the issue of whether a motion for a more definite statement of fact is barred under Rule 12(g) (2), and noting that it may in fact have merit, the Court will give Generic Defendants the benefit of the doubt and would entertain a timely Rule 12(e) motion. February 7, 2011 Opinion or Order Filing 36 ORDER: The Court believes it is necessary to conduct two additional bellwether trials involving issues not yet litigated, before considering remand of the MDL to the transferor courts. Therefore, the Court directs the Plaintiffs' Steering Committee and Merck to confer and to select, by April 15, 2011, two cases to be tried as additional bellwethers. One case must involve Fosamax use beginning before the July 2005 label change with a claimed onset of injury after the July 2005 label change. The other case must involve commencement of Fosamax use and a claimed injury date that both post-date the July 2005 label change. In the event that the parties cannot agree on the case selected for either or both of the above categories, each party must propose, by letter to the Court, three cases for each category of cases on which they have failed to agree. The Court will then randomly select one bellwethew case from the six total proposed cases for each unresolved category and promptly inform the parties of its selection. The plaintiffs, through the Plaintiffs Steering Committee, allege that the prescription drug Fosamax, manufactured by Merck & Co., caused adverse effects, in particular, osteonecrosis of the jaw. During discovery, the plaintiffs subpoenaed Dr. Bruce M. Psaty, who participated in a drug safety report issued by the National Academy of Sciences (the "Academy"). Dr. Psaty now moves to quash the subpoena pursuant to Rule 45(c)(3) of the Federal Rules of Civil Procedure... For the reasons set forth above, Dr. Psaty's motion for an order to quash is granted, and the subpoena shall be quashed, and as further set forth. (Signed by Magistrate Judge James C. The following witnesses are directed to appear for a hearing in Courtroom 20-C at the following dates and times: July 9, 2009; 11:00 a.m. - Dr. Mahyar Etminan. 1:45 p.m. Dr. John W. Hellstein. 3:30 p.m. Dr. Robert E. Marx (solely regarding his opinion about the risk of ONJ prior to three years of Fosamax use). July 10, 2009; 11:00 a.m. - Dr. Suzanne Parisian. 2:00 p.m. Dr. Curt D. Furberg. The Court sees no reason to hear from the other proposed experts at the hearing. The Court is concerned that much of the proffered expert testimony is cumulative. For example, Merck seeks to present two epidemiologists, two regulatory experts, and two endocrinologists. The PSC seeks to present two oral and maxillofacial surgeons and two regulatory experts. The paired testimonies convey practically the same information and opinion. While it was probably necessary to designate multiple experts for the unknown number of trials to be held in remanded cases, eighteen experts are far too many for one trial. The parties should keep in mind Federal Rule of Evidence 403 and Rule 16(d)(2)(D)&(0) of the Federal Rules of Civil Procedure. Therefore, the Court may limit each side to two experts on general causation (exclusive of case-specific causation experts), one expert on regulatory issues, and one expert on the efficacy of Fosamax. Alternatively, the Court may adopt the approach of limiting each side's case to six trial days. The Court first would like to hear the parties' views on this at the Daubert hearing. The parties are directed to confer on the matter and, one week in advance of the hearing, submit letter briefs no longer than five pages setting forth their views on the number of experts and the length of the trial.
