OPINION: Defendant Oppenheimer Acquisition Corp. moves for reconsideration of this Court's September 14, 2012 opinion which denied defendants motions to dismiss. In that opinion, the court omitted to include the necessary analysis of the position of Oppenheimer. Therefore, the motion for reconsideration is granted. OPINION: The motion to dismiss the statutory and common law fraud claims in the complaint is denied. However there will need to be further proceedings to clarify certain issues regarding the complaint. These further proceedings will also deal with t he breach of fiduciary duty and negligence claims, which the court declines to dismiss on the present record.
