Filing 7 OPINION AND ORDER re: #97699 5 FIRST MOTION for Reconsideration re; 3 Order Issuing Maritime Attachment and Garnishment filed by Amber International Navigation, Inc. Accordingly, plaintiffs motion for reconsideration is granted, but on reconside ration plaintiffs motion for the issuance of an ex parte order of maritime attachment against Miachart is again denied. Miachart is likely sufficiently present in this district to defeat a Rule B attachment against it. However, even if Miachart were not found here, its unequivocal presence in the Northern District of New York - a convenient adjacent district to this one - makes the issuance of an ex parte order of maritime attachment against it manifestly inappropriate. SO ORDERED. (Signed by Judge Gerard E. Lynch on 6/29/2009) (tve) Modified on 7/2/2009 (jab). |
