ORDER: The Court having been advised that the parties have reached a settlement in principle at the June 26, 2020 conference, it is ORDERED that the above-entitled action be and hereby is discontinued, without costs to either party, subject to reope ning should the settlement not be consummated within thirty (30) days of the date hereof. Any application to reopen must be filed within thirty (30) days of this Order; any application to reopen filed thereafter may be denied solely on that basis. Fu rther, the parties are advised that if they wish the Court to retain jurisdiction in this matter for purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the next thirty (30) days with a request that the agreement be "so ordered" by the Court. ORDER: Plaintiff Michael Anderson filed an amended civil rights complaint against the City of Mt. Vernon and Police Officer Sean Blute on December 16, 2011 alleging violation of 42 U.S.C. §§ 1983, 1988, the Fourth and Fourtee nth Amendments, and various state law claims. Doc. 20. Following a pretrial conference on May 6, 2020, the parties were referred to Magistrate Judge Paul E. Davison for a settlement conference. Doc. 90. At the settlement conference held on Ma y 29, 2020 before Magistrate Judge Davison, the parties did not settle. Accordingly, the parties are directed to appear telephonically before this Court on June 26, 2020 at 11 AM. ORDER: The above-captioned was filed on August 11, 2009. Doc. 1. On June 4, 2018, the parties attended a mediator session at the White Plains Courthouse. The parties have not taken any action in the case since then. Accordingly, the par ties are directed to provide the Court with a joint status report no later than April 15, 2020.
