Filing 25 MEMORANDUM OPINION AND ORDER: After de novo consideration of petitioners' objections to the Report, the Court finds that under New York's contemporaneous objection rule N.Y. Crim. Proc. Law section 470.05(2), petitioners' failure to ra ise a federal constitutional claim before the trial court is an adequate and independent state law ground barring federal habeas review. The Court adopts the Report in full and denies both petitions for writs of habeas corpus. The Clerk of the Court is directed to close this case. (Signed by Judge Richard J. Holwell on 2/7/12) (pl) |
