OPINION & ORDER re: 173 FIRST MOTION for Summary Judgment against Henry Vargas filed by Commonwealth Land Title Insurance Company. As set forth above, Vargas has failed to demonstrate the existence of any genuine dispute of material fact, and Comm onwealth has established that, as a matter of law, Vargas is liable to it for common law fraud. Plaintiffs motion for summary judgment is therefore granted, and it is hereby awarded damages in the amount of $1,122,500, jointly and severally with the other third-party defendants as compensation for this injury, as well as postjudgment interest and costs. (Dkt. No. 173.) The Court declines to award punitive damages. This disposition resolves Commonwealth's action against Vargas in its entirety. (Signed by Judge Sidney H. Stein on 10/21/2013) (rsh)

Because Commonwealth breached its contractual obligation to indemnify Levi for loss resulting from invalidity of the mortgage lien due to fraud, Levi's motion for summary judgment is granted in favor of Levi for $1 millio n, plus prejudgment interest of nine percent per year from September 11, 2009 until judgment is entered.
