September 24, 2014 Opinion or Order Filing 215 OPINION AND ORDER re: 168 MOTION To Exclude The Testimony of Plaintiff's Damages and Antitrust Liability Expert Under Rule 702 filed by The McGraw-Hill Companies, Inc., 149 MOTION for Summary Judgment filed by The McGraw-Hill Co mpanies, Inc. As set forth within, McGraw-Hill's motion to exclude the testimony of Dr. Frederick Warren-Boulton is GRANTED, and McGraw-Hill's motion for summary judgment is GRANTED in part and DENIED in part. Summary judgment is granted in favor of McGraw-Hill on all of Reed's remaining claims with the exception of Reed's unfair competition claim. June 6, 2014 Opinion or Order Filing 200 OPINION AND ORDER re: 172 MOTION to Preclude Plaintiff's Untimely Customer Declarations filed by The McGraw-Hill Companies, Inc. For the foregoing reasons, McGraw-Hill's motion to preclude the Ross and Brennan Declarations from consideration in the pending summary judgment motion is GRANTED. July 15, 2013 Opinion or Order Filing 144 OPINION AND ORDER: I write to resolve a dispute addressed in correspondence from defendant's counsel dated June 17 and 28, 2013 and in correspondence from plaintiff's counsel June 24, 2013. The reader's familiarity with the prior decis ion of Judge Sweet in this matter dated September 13, 2010 and my prior decision dated April 15, 2013 is assumed. Accordingly, defendant's application for an Order precluding plaintiff from using evidence from K Ross Company, Ulma Form Works an d Siemens for any purpose is denied without prejudice to renewal.
