OPINION AND ORDER: For the foregoing reasons, Rezende's motion to dismiss the fourth and seventh crossclaims is GRANTED. Rezende's motion to dismiss the second, third, fifth, sixth, and eighth crossclaims is DENIED. The motion to dismiss th e ninth crossclaim, for a constructive trust, is denied. The first crossclaim, for a declaratory judgment, implicates the contested ownership of the accounts at issue in the interpleader aspect of this litigation, and shall not be dismissed at this stage.
