Filing 96 OPINION AND ORDER: For the foregoing reasons, Albert is not individually liable to Malinowski, either under Article 6 of the New York State Labor Law or under common law. Based on the parties' joint representation to the Court, with this ruling having been made, the parties' signed settlement agreement, which had called upon the Court to resolve this single open issue, is now determinate.
