November 19, 2012 Opinion or Order Filing 65 MEMORANDUM OPINION AND ORDER re: 59 MOTION for Judgment NOV and a New Trial filed by Jason Meyers. For the reasons set forth above, we grant Meyers judgment as a matter of law pursuant to Rule 50 on Allams IIED claim, which she failed to su pport at trial with required medical evidence of her emotional distress. Should the Second Circuit disagree with that holding, we conditionally rule that Meyers would not be entitled to a new trial on the IIED claim. We also grant Meyers Rule 59 moti on for a new trial in part. As described above, we will schedule a new trial on punitive damages unless Allam stipulates to a reduction of the punitive damages award to $200,000 by December 14, 2012. February 24, 2011 Opinion or Order Filing 16 OPINION & ORDER, the Court DENIES Defendant's motion to dismiss for lack of subject matter jurisdiction, and GRANTS in part and DENIES in part Defendant's motion to dismiss Plaintiff's IIED claims. (Dkt. Entry No. 8 .) By no later tha n March 14, 2011, the parties shall submit via ECF and facsimile a joint status letter detailing how they intend to proceed, and whether they wish to be referred to a magistrate judge for settlement discussions.
