Filing 96 MEMORANDUM OPINION AND ORDER re: 70 MOTION for Summary Judgment DEFENDANTS' NOTICE OF MOTION FOR SUMMARY JUDGMENT filed by E. Williams, L. Hammond, M. Byrnes, M. Capra, J. Hayden, J. Fitzgerlad, L. Zwillinger, Davoren. For the fo regoing reasons, the Court grants the Defendants' motion for summary judgment in its entirety. Because the Court dismisses all claims, it does not consider arguments with respect to Plaintiffs' class action claims and Plaintiff Shelton 9;s claims for declaratory and injunctive relief against Defendants. This Memorandum Opinion and Order resolves docket entry number 70. The Clerk of Court is hereby directed to enter judgment dismissing all of the named Plaintiffs' claims and cl ose this case. The Court certifies, pursuant to 28 U.S.C.§ 1915(a)(3), that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
